Deciphering the Proposed Regulations and Their Effect on the Business Owner

On August 2, 2016, the Internal Revenue Service Issued its proposed regulations (Section 2704) which impact the transfer on interests in family owned companies, as well as the value of those entities for transfer purposes.  In this session we will:

Discuss the key regulations;
  • Discuss issues related to the regulations and their applicability for transfer planning purposes, as well as challenges which may be made to the regulations;
  • Provide insight into the impact for business planning purposes, as well as potential litigation; and
  • Facilitate discussion with the audience relative to applicability and client advice.

We will use case examples to illustrate the impact of the regulations and will provide insight for clients on the application to individual situations.  

Additionally, we will talk about the potential implications outside of estate and gift tax planning, including how these regulations may affect litigation valuations as well as merger and acquisition negotiations. 

This session will include a slide deck summarizing the key regulations and their impact, for use in communicating with clients.
