In tax, merger and acquisition, and litigation matters, attorneys often encounter valuations which do not appear to reflect the true value of a company. These situations bring to light concerns about the manner in which valuation determinations are developed, and concerns relative to judgment, for both the valuation practitioner and for counsel.
This session will feature Brandon Otis and Joshua Lefcowitz, Managing Directors in BDO’s litigation and valuation practice areas, and will highlight concerns regarding judgment used in the development of a valuation opinion, the valuation professional standards, and specific case examples where valuation misstatements were identified. The session is eligible for one ethics credit.

Brandon Otis is a Managing Director in BDO Consulting’s Pittsburgh office. He is a Certified Public Accountant and has been awarded the Certified in Financial Forensics and Accredited in Business Valuation designations by the American Institute of Certified Public Accountants. Brandon has also obtained the Certified Fraud Examiner designation from the Association of Certified Fraud Examiners and the Certified Valuation Analyst designation from the National Association of Certified Valuation Analysts.
Brandon has spent his career focusing on specialized and distinct business consulting matters. He has testified in federal and state court matters and is a frequent speaker on valuation, forensic accounting, and financial management related topics. With significant experience in a wide variety of industries, including oil and gas, insurance, manufacturing and distribution, professional services, medical practices and construction contractors, Brandon’s clients have ranged from Fortune 500 firms and some of the nation’s largest professional practice firms, to individuals and sole proprietorships.
Joshua Lefcowitz, CPA/ABV/CFF, CVA, CFE, ASA

Joshua Lefcowitz is a Managing Director in BDO Consulting’s Valuation & Business Analytics Practice in the firm’s Pittsburgh office. Mr. Lefcowitz has nearly 15 years of public accounting experience providing dispute advisory, forensic accounting, and valuation services for a wide array of purposes. Mr. Lefcowitz has performed business valuations, as well as valuation services related to intangible assets, purchase price allocations, intellectual property, oil and natural gas rights in Marcellus Shale formation, and goodwill impairment testing.
He has significant experience serving clients across a range of industry sectors, including oil and gas, healthcare, manufacturing, retail, professional services, technology, biotechnology, wholesale distribution, and advertising.
Mr. Lefcowitz is a Certified Public Accountant in Pennsylvania and is Accredited in Business Valuation and Certified in Financial Forensics. He also holds designations as an Accredited Senior Appraiser, Certified Valuation Analyst and Certified Fraud Examiner. Notably, Mr. Lefcowitz was one of only 15 Accredited Senior Appraisers to complete the American Society of Appraiser’s Inaugural Multidisciplinary Advanced Education in Healthcare Valuation Program.

Justin Lamanna is a Director in BDO Consulting’s Forensic Technology Services practice. He is a seasoned professional with 15 years of electronic discovery, litigation support, records management, digital forensics and information technology experience. Justin brings a unique expertise in developing tiered strategies with the ability to provide a consultative approach to each and every matter.
Justin works closely with law firms and corporate legal departments on litigation matters of all sizes, assisting with the overall discovery process. He has a strong background in customer service, consulting, designing and delivering customized services to meet clients’ needs.
Prior to joining the firm, Justin served as a Client Service Manager for UHY Advisors. There he was responsible for helping clients reduce the overall cost of litigation associated eDiscovery as well as creating and executing a new business and marketing plan within Northeast Region for the first ever UHY office based in Pittsburgh, PA.
