The proliferation of mobile device technology for both personal and business use has significantly increased businesses exposure to the risk of confidential data loss and theft.  During this program our discussion will begin with industry trends and why mobile device evidence should be handled like other Electronically Stored Information (ESI) evidence sources. This program will also review the common types of evidence that can be recovered and reviewed from mobile devices including text messages, GPS, call logs, applications and deleted information, and how this evidence can impact an expert’s analysis in commercial disputes.

We will conclude with case studies and discuss the practical application of how this information can be used in your matters.

Garry Pate is a Director in the firm’s Technology and Business Transformation Services practice with more than 18 years of experience in digital forensics, cyber security, information governance, e-discovery, internal investigations, and database management. He works extensively with organizations, attorneys, law enforcement and federal, state, and local governments.
 
Garry specializes in complex digital forensics, e-Discovery, and cyber security for matters that involve a range of issues, including intellectual property theft, business technology, copyrights, patents, trademarks, as well as employment, environmental, data breach, and numerous other disputes.
 
Garry has held several positions managing digital forensic and e-discovery projects, including most recently as director within the Dispute Advisory & Forensic Services Group of Stout, Risius, Ross (SRR) in Washington, D.C. and, prior to that, as an IT specialist with the Securities and Exchange Commission (SEC), where he was a founding member of the computer forensic laboratory analysis team. Garry has worked on numerous high-profile matters, including the SEC v. Enron and the United States v. Moussaoui, and has served as an expert witness providing testimony on forensic analysis on a broad spectrum of subject matters.

Jim is a Senior Manager in the Pittsburgh office of BDO. He has more than 15 years of service and expertise in fraud and forensic auditing/investigations, ethics and compliance reviews, fraud risk assessments, and the development and implementation of internal fraud audit/investigation units.

Mr. Carroll previously spent 10 years in the Internal Audit Investigations team at a Fortune 200 manufacturing company, handling damage calculations and recoveries from fraudulent billing schemes, employee misconduct investigations, and highly sensitive senior/executive level employee investigations. His prior experience also includes positions at large international companies in the life sciences and financial services sectors, providing internal investigation, internal audit, and financial reporting control services.

His practice is concentrated in the areas of forensics, compliance, and investigations, including: regulatory compliance, forensic accounting, internal and external fraud audits/investigations, and commercial and economic damages.
