BDO Talks Tariffs: Supreme Court Rejects IEEPA Tariffs—Practical Guidance for Importers

Recording

The U.S. Supreme Court’s decision invalidating tariffs imposed under the International Emergency Economic Powers Act (IEEPA) could have immediate impacts for importers and global supply chains. Potential effects include imposition of new tariffs under Sections 122, 232, 301, and/or 338, IEEPA refund opportunities and downstream impact, and continued enforcement and compliance risk.

In this webcast, we will explain what the decision does—and does not—mean in practice, highlight key U.S. Customs and Border Protection (CBP) compliance considerations, and outline practical next steps for evaluating exposure, strengthening documentation, and pursuing potential refund or recovery pathways.
