State Tax Litigation: The Decline of Judicial Deference

This article reviews the role of judicial deference in the interpretation of administrative guidance. It discusses prior decisions on the topic, which have tended to shy away from granting wide discretion to administrative agencies that write that guidance, as well as forthcoming U.S. Supreme Court decisions that will affect the concept.
